Mourning Mother Filed Los Angeles Wrongful Death Lawsuit

A tragic accident at a California off-road race killed seven people and caused injuries to ten more in August of 2009 and has now seen the first Los Angeles County wrongful death lawsuit filed in December 29th as a result.

The mother of Andrew Therrien, a 22-year old Riverside man along with a Los Angeles accident attorney has filed the lawsuit, naming Brett Sloppy, the driver of the truck which struck Therrien and MDR Productions, the race's promoter, as defendants.

Although the fans were supposed to be at least 100 feet away from the off-road track, this safety precaution was ignored, and the crowd lined the track. Therrien's mother, Doris Levinson, claims in her Los Angeles lawsuit that Mr. Sloppy was driving recklessly, without regard for the safety of the onlookers and that MDR willfully neglected to properly staff and monitor the event, creating a dangerous condition for onlookers.

No temporary fencing had been erected to keep spectators at a safe distance, there was no event operating plan, and no pre-race course monitoring took place. Additionally, no hazard information signs were posted and no rules of conduct for spectators were in place during the race.

Ms. Levinson stated that her son pushed his three-year old daughter, Kaylin, out of the way right before he was struck by the 2000 Ford Ranger driven by Sloppy. The California Bureau of Land Management, which manages the off-road recreation area used by MDR, has also been served with a claim - a precursor to a lawsuit - and has six months to respond to the allegations.

Levinson holds the BLM equally responsible for the accident which took the life of her son. The BLM has already accepted responsibility for failing to follow its own rules by not having a pre-race consultation with the event promoter, not requiring the promoter to have an operating plan, not examining the race course before the race and failing to have a BLM staff member present during the race. More lawsuits from these Los Angeles personal injuries are expected to follow.
