
California school district reaches $1.3 million settlementby Shawna Dashwood, August 15th, 2011 The Vislia Unified School District in Visalia, California, has reached a settlement with Nick Smallwood in which $1.3 million will be paid after an employee allegedly caused a car accident while drinking and driving in 2007, the Advance-Register reports. According to the news source, Leslie Huber was allegedly driving under the influence of alcohol on Highway 99 in Galt when he struck another vehicle, driven by Smallwood, causing him to suffer serious injuries. Huber was in Sacramento County for an educator's conference when the accident occurred, and pleaded no contest to DUI, which earned him five years probation. Smallwood then hired a car accident attorney and filed a complaint alleging that Huber was in the "course and scope of his employment with VUSD," and that the district should be held responsible for the accident, as well as Hubert, the media outlet stated. VUSD officials maintain that Hubert was not employed by the district in any way when the accident took place. According to the National Highway Transportation Safety Administration, there were 950 alcohol-impaired driving fatalities in California in 2009.
