Driver considers lawsuit after accident allegedly caused by poorly maintained road

A car owner whose vehicle was allegedly destroyed when the bricks that were used in the construction of North Mechanic Street in Jackson, Michigan, fell apart is now deciding whether to sue the city of Jackson for the damages, Michigan Live reports.

"Maybe," Patrick Hoxie said of a possible lawsuit. "We tried to get more documents from the city concerning how that road was built. We have real evidence that it was not built properly."

Hoxie seeks $5,000 from the city after his 2001 Oldsmobile Alero, driven by his son at the time of the accident, was totaled, according to the media outlet.

On Wednesday, January 4,  Jackson District Judge Darryl Mazur allowed the summary disposition motion from the city of Jackson to have the case dismissed, after it argued that it was immune to such lawsuits.

However, Hoxie's car accident lawyer states the city has no such immunity because city officials knew about the potentially dangerous roadway problems.

According to the Michigan State Police, 70,501 people were injured in car accidents across the state in 2010, resulting from 282,075 total crashes.
