
DUI driver sues crash victim's family, claims crash wasn't his faultby Wanda Derllump, January 16th, 2012 A Florida man who pleaded guilty to DUI manslaughter after a car accident in 2007 is now suing the family of one of the three people killed in the accident, The Associated Press reports. The news source states 38-year-old David Belniak of Spring Hill filed the complaint, which alleges the crash was not his fault, although he has already been sentenced to 12 years in prison following his guilty plea. Belniak's auto accident lawyer told the Tampa Bay Times that her client deserves compensation for pain and suffering and medical bills stemming from the accident, and that the crash was in fact caused by driver Ray McWilliams, according to the news source. Authorities stated that the initial accident occurred when Belniak allegedly crashed into the back of the victim's car while it was stopped at a red light. Testing indicated Belniak had alcohol and drugs in his system at the time of the crash. According to the National Highway Traffic Safety Administration, 770 people were killed in drunk driving crashes in 2009, comprising 30 percent of all roadway fatalities.
