Illinois jury awards Edwardsville woman more than $8,000 after car accident

On Tuesday, June 12, a jury in Madison County, Illinois, awarded the plaintiff in a car accident lawsuit more than $8,000 in damages, the Madison Record reports.

According to the news source, the two-day trial took place in Judge William Mudge's courtroom in Madison County Circuit Court. The jury awarded 50-year-old Rebecca Lanter $8,081 for injuries she suffered in a car accident in 2010 she claimed was caused by a St. Louis man.

The lawsuit, filed on December 6, 2010, claimed her neck, shoulder and lower back were all injured in the crash, which allegedly occurred when she was rear-ended by Gary Taylor, who was driving a small sedan at the time of the crash. However, the sum came in much lower than Lanter's car accident attorney had anticipated, the media outlet stated. In closing arguments, Lanter's lawyer requested $30,000 in damages, compared to the $3,632 the defense attorney had insisted upon.

Her lawyer stated that Lanter was driving in the westbound lanes of Rock Road near Illinois Route 3 in Granite City when the accident occurred. Although the defense attorney claimed Lanter had no signs of pain while in the hospital, and insisted the $30,000 sum was too large, Lanter's lawyer reminded the courtroom that the accident did indeed result in serious injuries.

"She was taken off work for her injuries," her lawyer said. "Movement exacerbated her pain. Even though she was taking medication, she wasn't doing well."

The attorney added that Lanter could no longer do laundry or carry heavy loads as she used to, and that her "life changed for her after the accident."

"The defense admits he was negligent," he added. "The defendant also admits his negligence was a proximate cause of injuries to the plaintiff."

Lanter, a social worker at Chestnut Health Systems, claims Taylor asked her not to contact police after the accident, which she says caused her to lurch forward, injuring her neck.

According to the Illinois Department of Transportation, 88,937 people were injured in car accidents across the state in 2010, and another 927 were killed in crashes. Those who have been affected by such a crash may want to contact an accident lawyer to determine what legal action can be taken.
