
Iowa man involved in fatal crash charged, sued by survivorby Graham Allchurch, August 30th, 2011 A man who was injured in a Nevada, Iowa car crash that killed an Ames woman has filed a complaint against the other driver in the accident, who has also been charged by the Story County Court, the Ames Tribune reports. According to the news source, Richard Diltz, who works as a contractor in Madrid, filed the lawsuit on Thursday, August 25, against 42-year-old Jeffery Clendenen, alleging that he caused the crash that killed Amy Rogers and left him with life-threatening injuries. Diltz's auto accident lawyer stated that it was purely coincidence that the lawsuit was filed on the same day that Clendenen was arrested for vehicular homicide. The lawsuit claims that Diltz suffered lasting effects from the crash which permanently impaired his ability to return to work after extensive hospitalization and rehabilitation, and seeks an unspecified amount of damages. "He spent a substantial amount of time in the hospital following the collision," Diltz's attorney said. "He’s recovered to the extent that he can, but he still has residual problems." The Story County Sheriff's Office said that Clendenen was driving under the influence of alcohol when the crash occurred, according to The Associated Press.
