
Lawsuit filed after car backs out of driveway, accidents occurs in Texasby Graham Allchurch, January 3rd, 2012 A Texas man has filed a lawsuit against another driver, claiming he was struck by the second motorist as he was backing out of his driveway onto the busy street, the Southeast Texas Record reports. According to the media outlet, Charles Pace II alleges he was traveling on Sixth Avenue in Beaumont on January 22, 2010, when Richard Pastorella backed out of a driveway and allegedly collided with Pace's car. Pace claims the accident led him to pay high medical costs, caused him to lose his earnings and capacity to earn and also led to sustained physical impairment, physical pain and mental anguish. Pace's car accident lawyer stated Pastorella negligently failed to maintain control of his vehicle and failed to yield the right-of-way. In the complaint, Pace says he is seeking an unspecified amount, with additions costs, interest and other relief deemed just by the court, the news source stated. Judge Milton Shuffield, of the 136th district, will preside over the case. According to the National Highway Traffic Safety Administration, there were 2,998 car accident fatalities in Texas in 2010.
