Lawsuit filed against Arizona after alleged car accident mix-up

The state of Arizona is being sued after Department of Public Safety officials allegedly failed to follow proper protocol regarding the crash of Abby Guerra, 20, who they reported died in a recent car accident, USA Today reports.

According to the news source, Sergio and Maria Guerra had already begun making funeral arrangements for their daughter when authorities allegedly contacted the family again to tell them that their daughter had not been killed, but rather one of her friends. Officers then reportedly told the family Abby was alive at St. Joseph's Hospital and Medical Center.

The Guerras hired a car accident attorney who filed a complaint naming DPS director Robert Halliday, a DPS chaplain and four police officers as defendants, whom the family claims did not follow policies set by the department.

The Guerras' attorney stated that the family did not file the suit in order to win damages, although $250,000 was sought in a notice of claim in January, the media outlet stated.

According to KTAR Radio, DPS policy regarding positive identification states that "if positive identification cannot be accomplished for any of several reasons, dental records, fingerprints, DNA samples or birth certificates may be of value." The Guerras claim the DPS did not follow this policy.
