Minnesota family plans to sue after crash involving police squad car

A civil lawsuit is being drafted after a mother and her son were killed last year in a car crash with a New Ulm, Minnesota police squad car, the Mankato Free Press reports.

According to the news source, 80-year-old driver Myra Meyers and her 60-year-old son were killed when police officer Matthew Rasmussen allegedly crashed into their vehicle. Although a grand jury returned no indictments after deciding there was no probable cause for felony or misdemeanor charges, a State Patrol report prompted the lawsuit.

The victims' family's auto accident lawyer says the says the civil action may take off after witnesses have come forward claiming the speeding police officer's car did not have its flasher lights turned on.

Dana Wichmann of Waseca, the brother and son of the deceased, says she wants justice.

"I think New Ulm should rethink how they want to be protected and served because I don’t believe you can break the law to enforce the law," she said.

According to the National Traffic Safety Administration, there were 410 traffic fatalities in 2010, a 2.4 percent decline from the previous year.
