New York police deputy considers lawsuit

Early in July, Deputy Allen Gerhdardt of the Buffalo Police Department rushed to provide aid to a fellow officer in the pursuit of an allegedly drunk driver, but somewhere en route crashed into a guardrail, which sliced through the side of the patrol car, severing his legs, NBC affiliate WGRZ reports.

According to the new source, Gerhdardt is an officer dedicated to removing drunk drivers from the roads, making it an even higher priority than his injury at hand.

"This didn't have to happen, I didn't have to lose my legs, I didn't have to almost die and my kids be without their father," he told the media outlet.

Now, the Iraq war veteran, who flew over 500 combat hours, is considering consulting an auto accident attorney to file a lawsuit. The suit would charge the alleged drunk driver, not the county, town or state, in an attempt to set a precedent.

According to Alcohol Alert, New York saw 409 alcohol-related traffic fatalities, accounting for 33 percent of all fatal crashes in 2008, the most recent year for which data was available.

When asked if he would return to the force, Deputy Gerhardt responded "absolutely, I'll be back soon enough," the news provider stated.
