Ohio rescuers save woman from car accident, sue victim

After saving a woman from burning in her car following an accident, two men from Ohio are suing the victim of the crash, claiming to have suffered "permanent and disabling injuries" while performing the rescue, United Press International reports.

According to the news source, the lawsuit was filed by Mark Kinkaid and David Kelley, both of Marion, Ohio, against the woman who was trapped in the car, Theresa Tanner. The men allege that she was responsible for causing the accident in which the two citizens were injured.

The Columbus Dispatch reports that the two men were not emergency medical workers, but rather passers-by who wanted to help.

The men consulted a car accident attorney, who told the news source that rescuers suing those they helped is more common than most think.

The men are suing on grounds of the "Good Samaritan" law, which states that if someone being helped was negligent or reckless and created a dangerous situation, rescuers may recover damages.

The men allege that the women intentionally crashed the car in an attempted suicide, according to the news provider.
