Texas family sues ex-cop involved in fatal DWI crash

The family of a woman who was killed when an off-duty Fort Worth, Texas police officer allegedly smashed into her car after drinking, is suing the man who is currently in prison, the Star-Telegram reports.

Sonia Baker's family hired an auto accident attorney and filed a lawsuit alleging that officer Jesus Cisneros performed actions that constituted gross negligence. The family claims the crash was the result of "conscious indifference" to the welfare, rights and safety of Baker, and is seeking an undisclosed amount in damages, according to the news source.

The complaint was filed in Tarrant County on August 3.

After the crash, Cisneros resigned from the police force and pleaded guilty to intoxication manslaughter and was sentenced to 20 years in prison. In trial, he admitted plowing into Baker's PT Cruiser at about 2:15 a.m. after consuming eight beers and four shots of liquor at a bar, the Telegram stated.

The bar, Fort Worth's Pour House, was also sued, but a $600,000 settlement was reached outside of court.

According to the National Highway Traffic Safety Administration, there were 1,235 drunk driving accidents in Texas in 2009, comprising 40 percent of the state's total crashes.
