Texas motorcycle crash leads to wrongful death lawsuit

After a motorcycle crash killed a man in Houston, Texas, his widow has filed a lawsuit on behalf of their children, the Southeast Texas Record reports.

According to the news source, the complaint was filed on August 30 in the Galveston Division of the Southern District of Texas by Kathy Rice, naming Shirley Bobyk as a defendant in the case, whom Rice's auto accident lawyer alleges caused the August 15 collision.

The lawsuit states that Bobyk failed to yield to the right of way while driving in her truck, which was owned by her employer Imperial Transport Co., causing Roger Rice to allegedly crash into the truck. Rice suffered serious injuries after being thrown from his 1980 Honda motorcycle, the media outlet states.

"Because of defendant Shirley Bobyk's negligence, Roger Dale Rice eventually died from his injuries resulting from this accident," the complaint alleges.

Bobyk is accused of failing to maintain a safe distance and a proper lookout, as well as failing to take evasive action to avoid the collision, according to the Record.

According to the Texas Department of Transportation, there were 2,793 fatal motorcycle accidents across the state in 2009.
